TERMS AND CONDITIONS
1. Identity of the Seller
The website nuleworld.com (hereinafter, the “Site”) is operated by Nule Srl , with registered office at Via Tommaso Grossi 6, 20063 Cernusco sul Naviglio (MI), Italy. VAT number 14386290960 - REA MI - 2779464 - Email: info@nuleworld.com
( hereinafter, “Nule” or the “Seller”).
2. Scope of Application
These General Conditions of Sale (hereinafter, the “Conditions”) govern the offer, sale and delivery of the products marketed through the Site. Sales are made exclusively to consumers, i.e., natural persons acting for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out. The Conditions apply to all sales made in Italy and other member states of the European Union. Placing an order implies full and unreserved acceptance of these Conditions.
3. Pre-contractual information
Before concluding the contract, the Customer receives the following information in a clear and comprehensible manner:
- main features of the products;
- total price including VAT;
- any shipping costs or other additional costs;
- payment method;
- delivery methods and times;
- conditions, terms and methods for exercising the right of withdrawal;
- existence of the legal guarantee of conformity.
4. Nature of the Products
The products sold consist of clothing and accessories. The images on the site are for illustrative purposes only. Any non-substantial differences do not constitute a lack of conformity.
5. Conclusion of the contract
An order placed by the Customer through the Site constitutes a binding contractual proposal. The contract is deemed concluded when the Customer receives the order confirmation via email. The Seller reserves the right to refuse orders in the following cases:
- product unavailability;
- obvious error in price or description;
- suspected fraudulent use of the site.
6. Prices
All prices are expressed in Euro (€) and inclusive of VAT. For sales to other European Union member states, VAT is applied in accordance with current European legislation on e-commerce, including, where applicable, the application of the OSS (One Stop Shop) scheme. There are no customs duties for shipments within the European Union. Shipping costs are indicated separately before order confirmation. The price applied will be the one indicated at the time the order is placed.
The Seller reserves the right to change prices at any time. The price indicated at the time of ordering will prevail.
7. Payment Methods
Payment can be made using the methods indicated on the website. Transactions are handled through secure payment platforms. The Seller does not have access to the complete card details used.
8. Shipping and Delivery
Deliveries are made to the European Union countries indicated on the Website. Delivery times are indicative and non-binding, unless otherwise agreed. The risk of loss or damage to the products passes to the Customer when the latter acquires physical possession of the goods.
9. Right of Withdrawal
The Customer has the right to withdraw from the contract within 14 days from the day on which he acquires physical possession of the goods, without having to provide a reason.
The right of withdrawal must be exercised by means of an explicit declaration sent to the Seller's contact details or by sending a written communication to the email address: info@nuleworld.com.
10. Return conditions
The customer must return the products within 14 days of the withdrawal notification. The products must be:
- unused;
- whole;
- complete with original labels;
- returned in the original packaging.
Returns will not be accepted if the original labels are removed or altered, except for the mandatory rights provided for by the legislation regarding the legal guarantee of conformity.
The direct costs of return are borne by the Customer, unless otherwise indicated on the Site.
11. Refund
The refund will be made within 14 days of receipt of the goods or proof of shipment. The refund will be made using the same payment method used for the purchase.
The Seller refunds: the price of the product and the original standard delivery costs. Any additional costs resulting from choosing a delivery method other than the standard one offered will not be refunded. The Seller may withhold from the refund an amount corresponding to the decrease in value of the goods resulting from handling other than that necessary to establish their nature, characteristics and functioning.
12. Exceptions to the Right of Withdrawal
The right of withdrawal is excluded in the cases provided by law, including:
- customized products upon customer request;
- goods that are used or damaged for reasons not attributable to the Seller.
13. Legal Guarantee of Conformity
All products are covered by the legal guarantee of conformity for 24 months from delivery, pursuant to Directive (EU) 2019/771 and the national implementing legislation. In the event of a lack of conformity, the customer has the right, free of charge, to:
- repair or replacement of the product;
- alternatively, price reduction or termination of the contract in the cases provided for by law.
The Customer is required to report the defect within the terms established by applicable legislation. The consumer's non-derogable rights under the law of the Member State of residence remain unaffected.
14. EU Regulation 2018/302 (Geoblocking)
Nule does not apply unjustified discrimination based on the Customer's nationality, place of residence, or place of establishment within the European Union, except for objective limitations related to logistics or applicable legislation.
15. Technology platform
The Site is created using an e-commerce infrastructure provided by Shopify . Shopify provides exclusively technological hosting and technical management services for the platform. The Seller remains solely responsible for contractual relations with the Customer.
16. Use of the Site
The customer undertakes to use the site exclusively for lawful purposes and not to carry out activities that could compromise its functioning or security.
17. Intellectual Property
All content on the Site, including trademarks, images, text, designs, and logos, is the exclusive property of the Seller. Any unauthorized reproduction, distribution, or use is prohibited.
18. Processing of Personal Data
The processing of personal data is governed by the Privacy Policy and Cookie Policy published on the Site, drafted in compliance with Regulation (EU) 2016/679 (GDPR) and applicable legislation.
19. Limitation of Liability
The Seller is not responsible For indirect or consequential damages arising from the use of the products or the Site, for delays or disruptions attributable to force majeure, unforeseeable events, or the carrier's liability. In any case, the consumer's mandatory rights under the law remain unaffected.
20. Applicable Law and Jurisdiction
Contracts concluded through the Site are governed by Italian law. If the Customer is resident in another member state of the European Union, he/she benefits from the protection provided by the mandatory provisions of his/her state of residence. For disputes, the court of the place of residence or domicile of the consumer has jurisdiction.
21. Changes to the Conditions
The Seller reserves the right to modify these Conditions at any time. The changes will take effect from the date of publication on the Site and will apply to orders placed after that date.
